Administrative history note

The records were collected by Haydn G. Jones, esq. of 35, St. Mary Street, Monmouth and were listed by the County Archivist in 1970, whilst still in his keeping. They were subsequently deposited with Gwent Archives. However, some of the deeds including those of the earliest dates had been sold to a London dealer in the interim period. Photocopies of the 'missing' documents were made for the collection and these photocopies (originally referenced as MISC MSS 969) are available. However, some documents (nos. 3, 4, 13, 14, 53, and 59) were not copied and neither the originals nor photocopies exist in the collection, although these documents are fully described in the catalogue.

Know all men that we George Derneford, lord of part of the manor and lordship of Crick and John Robynet lord of St. Pier have quit claimed to John ap Ieuan ap Jankyn Kemeys of Caldecote and Alianora, the daughter of William Herbert his wife and her heirs, assigns all right and claim which he has or will have in either the whole (mill) of Sudbrook, with suit and all appurts., and also in all our part of Mulleham which extends form the mill pond in the west and continues lengthways 4 perches and in length between the mill pond and the stream which descends from the dam of the same mill and also 5 perches of land from the west part of the same mill breadth from the said mill towards the Green Ditch. Thus, neither we the aforesaid George and John Robynet nor our heirs or any one else on behalf of us nor in our name of may be able to sell or claim in the future any part of the above mentioned mill and appurts., nor in the 2 parcels of land nor in any other parcel.  D1317/27 ENFEOFFMENT. 1. Wm. Howell of Caldicott, yeoman and Anne his wife. 2. Francis Herbert of Caldicott, gent. 45/-. 1/2 acre land arable or pasture with appurts. par. Caldicot, and parcell of the manner of the west ende there in a field there called Lower South field between the lands of Richard Harper, gent. and the lands of Phillip Howell, the one end abutteth upon the longe Forehead and the other abutteth near glebe lands of the vicar of Caldicott. 7 Feb 1624/5 

 D1317/65 COPY PROBATE OF WILL. Francis Herbert, gent. 28 April. Annuity of £50 to his wife and that all his customary dues that were paid to this son Hugh Herbert should be towards his wife, "better mayntenance and of her children". His wife is also to have the land which is at the Rodge to be sowde into halves with his mother, yielding her halfe the corne and woods for her house to be cut down upon his son Hugh's charge and shall be carried to any place where his do please to dwell near unto the place in Monmouthshire and whatsoever that I do not lay downe that standeth good in reason or law I shall refer to the gent. that I shall nominate to have dealings in that business between them my meaning is that whatsover my wife doth desire to have in reason that my verie good friends shall end all business between them, as long as my wife liveth. If his son Francis shall outlive his mother, he will enter upon all that she held. If the lease which is held from the Lord of Worcester shall have expired it shall be purchasable by his son Hugh from the same Lord whether it be in my wife's life by me or after her decease in part of recompence of manie a good acre of customarie lands. He is to pay £200 to his daughter Florence and £200 to his son Hugh and £200 also to William Herbert and if his executors (good friends) do find that his son Richard can stay a year or 2 for his portion, he is also to be entitled to £200. He also give the use of £200 to George his son if his brother Francis shall happen to die before he comes unto his age of 21 years, and if Francis shall attain 21 then George is to receive £200 as long as his executors think fit and also give £200 to his daughter Cissile when his executors think it fit. If his wife does not agree to these terms she can take the thirde of all his free lands and whatsoever besides the law will give her leave with the consent of his good friends. He desires his good friends to oversee his house in Bristol and to make a dividall of some part of these things. He leaves all his stock in Caldicot to his son Hugh unless his wife has a desire to any cows or any other cattle or sheep, his son Hugh is also to provide her with bread, cheese, butter and any other neccessaries and also to harvest in all the corn and divide it. Mess. or dwelling house, 1 barn, 1 garden and 9a. land, arable, meadow or pasture thereunto belonging with appurts. situate in Sudbrooke whereof 4a. of which lyeth in the Grove, upon the Cliffe abutting upon the bank of the River of Seaverne, 1a. is commonly called the Head Acre and abutteth upon certen lands there sometymes heretofore the lands of John Mulgreys. 1a. known as Berrowe Acre and abutting upon the lands of Walter Beale which were sometymes the lands also of John Mulgary, 1a. lyeth abutting upon the Grove land known as Bryery acre 1a. lyeth under the Stapp Tree and abutteth upon the Cliffe acres and the other acre is commonly called Bedd Acre and abutteth upon the Myddle furlonge there, all of which premises John Inon dec'd father of Daniel and John Inon heretofore bought and purchased to him and his heirs of the gift and grant of Morgan Myricke Elizabeth his wife and the first party have granted to Hugh Herbert his heirs and assigns. 4a. pasture with appurts. called Stapps situate in Sudbrooke and Portscuett which the said John Inon the father bought of John Williams of Sudbrook, and also all houses buildings etc., belonging. 16 Mar 1634/5

 D1317/2 CONVEYANCE IN FEE. 1. Vere Herbert of Caldicott, esq., William Herbert, gent. son and heir of Vere Herbert by Margaret his wife. 2. Martha Price of Bristol, widow relict and also executrix of the will of John Price, esq., her late husband dec'd. 3. John Edwards of Bristol, gent., and Melborne Taylor of the same city, gent. 4. William Williams of the city of Bristol, clerk, William Aldey of Chepstow esq., the only acting executors named in the will of John Ramsey late of the city of Bristol, esq., deceased. The hereinafter mentioned manor and premises are mortgaged to Martha Price or to other persons in trust for £2,000 and whereas John Ramsey by certain Articles of agreement 30 May 1720 agreed with the lst party for the purchase of the inheritance of the manor for £1,640 and by a subsequent agreement added thereto £21 for the addition of another small parcel of land called Crownhill not include in the Articles which said sum of £1,661 was to be paid and applied for and towards the payment and satisfaction of the said mortgage money and interest due to the said Martha Price on assignment of the said mortgage to persons in trust for the said John Ramsey. The will of Ramsey is cited 25 August 1720, to which he says that by a lease dated May 2/3 1716 he conveyed all his estate of inheritance lying pars. Subbrook, Portskewet and Caldicot to John Curr, James Hollidge and Giles Eyre esq., and Joseph Edwards in trust for their survivors that they may convey the premises to whom ever Ramsey should appoint by any deed and he has contracted with Vere Herbert in the said articles for the purchase of the inheritence of the manor of Sudbrook to be conveyed to Ramsey and his heir and he has paid £200 of the purchase money and now calls upon his executors to complete the purchase. The estates are to be conveyed in trust to his executors for Ellen Sansom his granddaughter. There is a codicil attached which mentions that on perusal of the title of the estate, the latter were charged with a mortgage for £1,000 which Vere Herbert was unable to make good and he therefore directs his executors not to proceed with the purchase except with safeguards, £1,640 by William Williams and William Aldey to Martha Price being part of the mortgage money by and with the consent of Vere Herbert and William. Manor or lordship or reputed manor or lordship of Sudbrook with the right members and appurts., also the advowson, donation, presentation and right of patronage of and to the parish church of Sudbrook, also capital mess. or mansion house and garden with appurts., par. Sudbrook, and 3 parcels of land adjoining now in the tenure of Henry Palmer called the 2 four acres and Mill close and also all those 2 acres in Millfield bounded by Gales close on the east and the lands of William Jones on the north and all that piece of pasture ground called the Warren 14 acres except 1/2 acre thereof claimed by one William Jones and all those 3 acres thereto adjoining called the Castley abutting upon the Severne on the south and 5 parcels of meadow adjoining to each other containing 16 acres bounded by the wharfe and Little Bisditch on the north and west; and the mill pond on the east, also parcel of ground called the Wharfe, 8 acres bounded by the River Severn on the south part and lands of Thomas Lewis, esq., on the west and Great Bisditch on the north and 3/4 acre of arable land lying in the Southfield the lands of the said Thomas Lewis and of Blethwyn Smyth lying on the south and west parts hereof and the new way to the New passage lying on the north part thereof and also all that 1/4 acre lying on the side of the Cliffe abutting on the lands of the said Blethwyn Smyth on the north east part and the River Severn on the south east part thereof and all those 2 acres of land in the tenure of Henry Palmer bounded by the hedge of the lands late of the said John Ramsey called the Steps on the south west and lands of Thomas Lewis on the north east and the River Severn on the south east part thereof all of which premeises par. In consideration of the marriage already had and solemnized between William Herbert and Winifred his now wife, daughter of Henry Scudamore and for a competent joynture or settlement to be had and provided for Winifred in case she shall happen to survive him the said William Herbert in consideration of £200, William Herbert has enfeoffed released and confirmed into Philip Hoskyns and John Curr all that mess. with appurts. commonly known as Caldicott Court and wherein the said William Herbert doth now inherit and dwell and also all houses, outhouses, barns, stables, edifices and other buildings, gardens, orchards etc. and also portion of tythes there well known and distinguished and payable out of certain lands called the Lords Meads and of the west end of Caldicott, another mess. with appurts. now in the possession and occupation of George Bowler, par. Caldicot and under-tenant to William Herbert at 40/- p.a., pars. Caldicot, Ifton, Magor and Rogiet. There was then owing to Elizabeth Herbert, widow on account of rent £20 and that Catherine Scudamore, spinster, had executed with John Scudamore to Richard Jenkins of Hensal, co. Glam., esq., one bond 16 April 1700 for £100 and that John Scudamore had executed unto Winifred Scudamore par. Welsh Newton, co. Hereford, spinster, one bond 29 September 1700 of the penalty of £20 conditioned for the payment of £10 with its interest at a day then past upon action of which bond there was the due for interest of £1 3. 6. and that Catherine Scudamore together with John Scudamore had duely executed to Elizabeth Prichard of Mon. spinster, one bond 20 May 1703 for £20, then John Scudamore had executed to Mary Prichard now wife of John Rolls, a bond 11 May 1702 for £20 and that John Scudamore and Catherine as his surety had duly executed unto the said Mary Rolls a bond endorsed on the recited indenture 20 November 1701 for £20 and John Scudamore had executed to Henry Scudamore bond 1 August 1702 for £40 on account of which said bond there was owing and other bonds but reciting that failure having been made in payment of the said principal and other money the above mentioned bonds and debts were then in force and that the said John Scudamore was then minded to secure the payment thereof and other the debts which shall be thereon endorsed - it is witnessed that for and towards the paying and satisfying in manner in the said recited indentures herein after expressed all the said debts whatsoever as aforesaid and all such debts which should be expressed in any endorsements upon the said recited indenture, John Scudamore demised, granted bargained and sold to George Jones and Robert Andrews - all that mess. wherein Florence Waters, widow - then lately inhabited, par. Gwernesney with all barns, stables, gardens and orchards thereunto belonging and all those lands arable meadows, pastures woods and underwoods to the same belonging pars. Gwernesney and Langiview to the then lands of Walter Jones on the e. to the gleebe lands there on the s. to the land called Gibbons Land on the west and to the lane leading from Usk towards Mon. nearing to the lands hereinafter mentioned called Finnon Owen and Kae Kenoll on the north and all those 2 parcels of land called Finnon Owen containing c. 14a. and Cae Kenoll c. 7a. both which closes are lying together within the said pars. nearing to the lane aforesaid to the lands called the Barne Close and Cae Pull Crach on all or some parts or sides thereof and also all other the lands and tenements of John Scudamore situate same pars., all which mess. lands and premises were then vested and lodged in Richard David and Valentine Gabriel respectively for certain long terms of years without impeachment or waste in mortgage towards the securing the repayment of the sum of £200 in the whole with interest for the same to be computed from the 7 September 1706 together with all ways, waters and appurts. to the premises belonging, for £1,000 subject nevertheless to the payment of the yearly sum of £4 payable out of the said lands called Cae ffinnon Owen and Cae Kenoll unto George Scudamore gent., brother of John Scudamore for the life of the said George and subject to the payment of £20 payable out of the premises to Christopher Scudamore another brother. Wherefore, since John Scudamore now non compos mentis, Henry Scudamore has paid off all the debts with his own money and for 3 yrs. has supported and maintained the said John Scudamore, now Henry Scudamore for better securing the payment of all such money as shall upon a just account and for the premises appear due to him hath desired Robert Andrews (being the surviving trustee) to transfer and assign over the said trust and trust estate to himself. Above premises transferred to Henry Scudamore for the residue of 1000 years. 10 Aug 1721

 D1317/67 Copy Extract from the Registry of the Consistory Court of Worcester. Agreement. 1. Abbot and convent of St. Augustines, Bristol, Walter Newbury, diocese of Worcester. 2. Rector of Fylton - William Meredythe. Reciting that many years ago discord arose between the abbot and convent, proprietors of the parochial church of Almondsbury with the Chapel of Horfield depending on the same and belonging to it on the one part - William Meredythe the above rector of the other, concerning certain tythes, real, mixed and personal out of lands and tenements called Breweshold being within the common bounds and limits of the said chapel and the receiving of the tythes being placed and situated in the proceeds. In order to arrive at a settlement, with the consent of the Bishop of Worcester, we the abbot and convent shall hold and receive and our successors shall hold and receive for perpetual time all the above tythes peaceably without the reclaiming of William and paying annually for perpetual time upon the feast of St. Michael the Archangel 6/8. If the sum is not paid by Walter the abbot and convent the rector may enter upon the lands and in the same place to distrain and to seize take away drive away and impound and retain in their own possession the distraints until satisfaction shall be made. The premises are to be held for the term of the lives of Hillier and his wife and the life of the longest liver of them successively according to the custom of the manor. 38/2 p.a. £10 heriot. 24 Mar 1812

On 17 February 1813 - John Shadwell, same premises granted to his son John Augustus Shadwell and his wife in reversion upon the death surrender or forfeiture of Hillier but revocable upon payment or tender by the said Lord farmer of 1/- to J. A. Shadwell or the Steward of the Manor which said last grant was made void by payment to the steward on 10 November 1815. 14 Nov 1815

Thomas Hillier late of Bristol, now of Filton. 1 mess., or tenement and 1/2 yd land, meadow, feeding and pasture belonging and also 1/6 of a certain parcel of land called Kingsfield with appurts. situate at Filton within the manor aforesaid formerly in the tenure of John Barnsley and afterwards of Mary his widow and afterwards of John Gayner dec'd and afterwards of John Augustus Shadwell by virtue of a revocable grant to the said John A. Shadwell made 24 Oct. 1809, and which on the 19 March 1812 were made void which premises were granted on 24 Oct. 1809 to Henry Eugene Shadwell in reversion by a revocable grant and which said last mentioned grant was defeated and made void on 19 March 1812 and the said premises were granted to Hillier and he was admitted thereof 24 March 1812 and were granted by the Lord farmer at a court held on 17 Feb. 1813 to his son John Augustus Shadwell and his wife in reversion upon the death surrender or forfeiture of Hillier but revocable upon payment or tender by the said Lord farmer of 1/- to the said John Augustus Shadwell and which grant was, upon payment so made to the said steward for that purpose on 10 Nov. 1815, made void. The premises were surrendered by Hillier at a court held 14 Nov. 1815 to the lord farmer having been granted to Hillier 24 March 1812 defectively the last mentioned in reversion to J.A. Shadwell and his wife having been made previously void for the purposes and to the intent that at the said court held on 14 Nov. 1815 the said Hillier might take and be admitted to the same premises by a good grant and thereupon Hillier was admitted at the said court held on 14 Nov. 1815 to the said premises by the said Lord farmer which said premises were granted by the said Lord farmer at a court held on 14 Oct. 1817 to the said Henry Eugene Sandwell and his wife in reversion upon the payment or death, surrender or forfeiture of Hillier but revocable upon payment or tender by the said Lord Farmer of 1/- to Henry Eugene Shadwell which said last mentioned grant was, upon such payment so made to the said steward on 22 January 1882, defeated and made wholly void and it being apprehended that the grant made to Hillier on 14 Nov. 1815 was defective the premises have been surrendered at this court, the last mentioned grant in reversion to the said Henry Eugene Shadwell and his wife having been made void for the purpose and to the intent that at this court Hillier may take and be admitted to the same premises by a good customary grant therefore Hillier is admitted for the term of his life and the widowhood of any wife he may happen to leave according to the custom of the manor. £1 18. 2. and heriot. £1700. 25 Jan 1822 

 D1317/46 DEED OF CHARGE. 1. James Thatcher, yeoman, churchwarden, par. Filton, co. Gloucs. It has been decided that certain repairs ought to be made to the parish church and that a sum of £200 ought to be spent - meeting 17 April 1844, another meeting 23 August, resolved that a tax of 3/4 in the £ upon the annual value of the property to the said parish should be made and raised for the purpose of rebuilding and enlarging the church pursuant and under the authority of the Act of Parliament, 59 George III, 134. James Thatcher has applied to Thomas Hillier, par. Filton, yeoman for a loan of the sum of £200 upon credit of the church rates and Hillier has agreed to advance the same. He charges the parish with the sum of £200 and with the repayment thereof. 3 Mar 1845
