WILL (copy) of Thomas Gabb of town of Abergavenny, esq. To his wife Alice Gabb, so much of his household goods, plate and linen as she shall think proper and necessary towards the education and maintenance of his 5 youngest children - namely, Mary, Henry, Edward, James and Baker; and to give to these 5 children in such manner as his wife shall think proper, all the residue of his household goods and personal estate whatsoever. He directs his wife to sell and dispose of his household goods, and call in and receive all such money as shall be due unto him at his decease; and out of the said money to pay first of all his funeral expences and debts; and then to lay out the residue of his personal estate upon land and other good securities in trust until the money he owes by mortgage upon his real estate unto Mrs Elizabeth Hughs shall be called for; and then or sooner to apply the same money in discharge of the said mortgage as far as the same will amount to. To his wife Alice Gabb, 1 annuity or yearly sum of £12 to be paid out of his real estate by 2 half yearly payments in equal proportions. To his cousin James Gabb and his friend William Powell, both of the town of Abergavenny, gentlemen, all those messuages or tenements, farms, lands and Hereditaments commonly called Upper and Lower Goytreys situated in par. Grosmont, co. Mon., and in par. Lancillo, co.Hereford. - Upon this special trust that they shall by and out of the rents, issues and profits thereof in the first place keep down the interest of such principal monies as are secured thereon by mortgage, and to apply the residue of such rents and profits from time to time towards discharge of the said principal monies until the premises shall be wholly discharged of all incumbrances. – Then upon trust to permit the rents, issues and profits of the said premises to be received and taken by his cousin Baker Gabb until his eldest son John Gabb shall attain the age of 25. But in case it should happen that the said John Gabb should die before he attains the age of 25 without leaving any issue, then he devises his said messuages, farms, lands and premises called Upper and Lower Gotreys unto Baker Gabb the second son of his cousin Baker Gabb when he attains the age of 25. But in case he the said Baker Gabb the son should die before he attains the age of 25 without issue, then he devises the said premises unto the said Baker Gabb the father during the term of his natural life; and after his decease he devises all the said premises unto James Ash Gabb, son of his cousin James Gabb for ever. Consideration: £269 The Transferors as Mortgagees hereby convey and transfer to the Trustees the benefit of the indenture of mortgage 28 Sep 1863 (called ‘The Principal Indenture’). The Trustees and the persons deriving title under them shall so far as regards any Purchaser, Lessee, Transferee or Mortgagor or other person interested in the right of redemption hold the aggregate mortgage debt of £1,200, as if the same were money belonging to them on a joint account and may exercise all statutory powers, give receipts and do any act or thing accordingly. Subject as aforesaid the Trustees shall stand possessed of the aggregate mortgage debt aforesaid and the interest to accrue thereon in trust as to £807 15s part thereof for the Transferors on a joint account and as to the sum of £392 5s balance thereof for the mortgage absolutely; and each of the said sums and the interest thereon shall rank equally without any priority between themselves and if necessary shall be paid proportionately. The transferors and mortgagee hereby agree that if the Transferors or Mortgagee shall request the other of them to concur with them or her in calling in the said principal sum of £1,200 or that part thereof to which the requesting persons shall be entitled or in enforcing or obtaining payment thereof or any interest due in respect thereof either by exercising the statutory power of sale or otherwise, then the persons to whom such request shall be made, shall comply with the same on being indemnified by the persons so requesting against all costs and expenses consequent thereon. (The Mortgagees) The Borrowers covenant with the Mortgagees to pay to them on 23 June next the sum of £500 with interest thereon from 23 Dec last at the rate of 5% p.a.; and also so long as any principal money remains due under the mortgage of 23 Dec 1899 (of freehold property known as the Half Moon Inn and Gunters Farm situate in par. To his wife Alice Gabb, so much of his household goods, plate and linen as she shall think proper and necessary towards the education and maintenance of his 5 youngest children - namely, Mary, Henry, Edward, James and Baker; and to give to these 5 children in such manner as his wife shall think proper, all the residue of his household goods and personal estate whatsoever. He directs his wife to sell and dispose of his household goods, and call in and receive all such money as shall be due unto him at his decease; and out of the said money to pay first of all his funeral expences and debts; and then to lay out the residue of his personal estate upon land and other good securities in trust until the money he owes by mortgage upon his real estate unto Mrs Elizabeth Hughs shall be called for; and then or sooner to apply the same money in discharge of the said mortgage as far as the same will amount to. To his wife Alice Gabb, 1 annuity or yearly sum of £12 to be paid out of his real estate by 2 half yearly payments in equal proportions. To his daughter Sarah Gabb, 1 annuity of £10 to be paid out of his real estate likewise. To his daughter Mary Gabb 1 annuity of £10 to be paid out of his real estate likewise.  D2536/20 WILL (attested copy) of Thomas Gabb of town of Abergavenny, gent. To his cousin James Gabb and his friend William Powell, both of the town of Abergavenny, gentlemen, all those messuages or tenements, farms, lands and Hereditaments commonly called Upper and Lower Goytreys situated in par. Grosmont, co. Mon., and in par. Lancillo, co.Hereford. - Upon this special trust that they shall by and out of the rents, issues and profits thereof in the first place keep down the interest of such principal monies as are secured thereon by mortgage, and to apply the residue of such rents and profits from time to time towards discharge of the said principal monies until the premises shall be wholly discharged of all incumbrances. – Then upon trust to permit the rents, issues and profits of the said premises to be received and taken by his cousin Baker Gabb until his eldest son John Gabb shall attain the age of 25. But in case it should happen that the said John Gabb should die before he attains the age of 25 without leaving any issue, then he devises his said messuages, farms, lands and premises called Upper and Lower Gotreys unto Baker Gabb the second son of his cousin Baker Gabb when he attains the age of 25. But in case he the said Baker Gabb the son should die before he attains the age of 25 without issue, then he devises the said premises unto the said Baker Gabb the father during the term of his natural life; and after his decease he devises all the said premises unto James Ash Gabb, son of his cousin James Gabb for ever.  D2536/40 TRANSFER OF MORTGAGE 1) Thomas William Williams of Brockweir, Tintern, co. Glos., retired farmer; James Farr formerly of Arkstone Court, near Hereford, but now of Cagedale Clehanger, co. Hereford, farmer (The Transferors). 2) Annie Jane Farr, the wife of the said James Farr (The Mortgagee). 3) The Transferors and the Mortgagee (The Trustees). Consideration: £269 The Transferors as Mortgagees hereby convey and transfer to the Trustees the benefit of the indenture of mortgage 28 Sep 1863 (called ‘The Principal Indenture’). The Trustees and the persons deriving title under them shall so far as regards any Purchaser, Lessee, Transferee or Mortgagor or other person interested in the right of redemption hold the aggregate mortgage debt of £1,200, as if the same were money belonging to them on a joint account and may exercise all statutory powers, give receipts and do any act or thing accordingly. Subject as aforesaid the Trustees shall stand possessed of the aggregate mortgage debt aforesaid and the interest to accrue thereon in trust as to £807 15s part thereof for the Transferors on a joint account and as to the sum of £392 5s balance thereof for the mortgage absolutely; and each of the said sums and the interest thereon shall rank equally without any priority between themselves and if necessary shall be paid proportionately. The transferors and mortgagee hereby agree that if the Transferors or Mortgagee shall request the other of them to concur with them or her in calling in the said principal sum of £1,200 or that part thereof to which the requesting persons shall be entitled or in enforcing or obtaining payment thereof or any interest due in respect thereof either by exercising the statutory power of sale or otherwise, then the persons to whom such request shall be made, shall comply with the same on being indemnified by the persons so requesting against all costs and expenses consequent thereon.
